I have been handling catastrophic DUI crashes throughout Pennsylvania for 30 years. I was involved with Mothers Against Drunk Drivers since I was in my 20s. My mother was the victim of a drunk driver. It changed her life forever. She was catastrophically injured. I’ll never forget it. She suffered until she passed.
A DUI driver is not negligent. They’re criminal. If someone hits you or causes a crash, and they’re drunk or high, they’re held more accountable in a different way than someone that makes a simple mistake. Juries don’t like drinking and driving. They respond with higher verdicts when someone’s the victim of a drunk driver. You’re obviously not at fault, but it’s more than just proving fault. If we can prove that they were drunk or high when you were injured, your case is worth substantially more because it’s a criminal act. They made a decision to drink and get behind the wheel. If you are the victim of that criminal act, it’s not mistake like many other crashes. It’s a criminal act that they need to be held accountable for, not just under the criminal law, but by us.
