Philadelphia Police Department Admits Mistakes

“We screwed up, folks…..” Those were the words spoken by Philadelphia Police Commissioner Charles Ramsey last week when he told news reporters that 1, 147 drunk driving cases may be in jeopardy because of problems with the breath test machines.

While this may be a problem for some criminal convictions, it does not prevent a person who has been hurt by a Philadelphia drunk driver from recovering damages in a civil lawsuit.  In order to recover damages in a civil lawsuit, other evidence may be presented that may be persuasive enough to allow the victim to recover damages without evidence from the breath test.
