Recovering Full Damages with Limited Tort After a PA Drunk Driving Accident

Monday, January 16th, 2012

It seems unfair that another driver was drunk and caused your Pennsylvania car accident injuries. You are right, it is unfair. Accordingly, Pennsylvania law may allow for your full recovery of pain and suffering damages even if you have limited tort coverage.

However, it is not enough that the other driver is arrested for drunk driving. Instead, an exception to Pennsylvania limited tort law exists only if a person is convicted of drunk driving or participates in the Accelerated Rehabilitative Disposition (ARD) program.

Experienced injury accident attorneys know how important a full recovery is to you after a drunk driving wreck and will work hard to get you the recovery that you deserve. Please contact us today for a free consultation about your rights.

A Look at Preventing Drunk Driving in 2012

Wednesday, January 4th, 2012

Recently, MADD’s National President wrote about what was accomplished by the organization during 2011 and what the organization hopes to accomplish in 2012.

Among its accomplishments in 2011 and its goals for 2012 are specific actions to prevent drunk driving accidents. Specifically, MADD has been and will continue to:

  • Support ignition interlock laws.
  •  Help parents talk to their children about the dangers of underage drinking generally and drunk driving specifically.
  • Call for increased sobriety check points.
  • Educate the public about the need for designated drivers.

Personal injury attorneys in PA, drivers, and anyone who travels by motor vehicle should join MADD in their fight against drunk driving and protect those traveling our roads from tragic drunk driving accidents, injuries and fatalities.

What Does MADD Think of Pennsylvania Drunk Driving Laws?

Tuesday, December 13th, 2011

Recently, Mothers Against Drunk Driving (MADD) put out its fifth report about each state’s efforts to end drunk driving.

MADD Gave Pennsylvania 1 out of 5 Stars

Pennsylania ranked among the worst states for preventing drunk driving accidents, according to the MADD study. The only star which Pennsylvania earned was for having sobriety checkpoints. Rhode Island was the only other state east of Texas to earn just one star.

As a PA auto accident lawyer who is recommended by MADD and who is committed to the safety of our citizens, I am concerned that our state scored so low.

Do you think Pennsylvania could do a better job preventing drunk driving accidents?

Different Slogan but Same Message

Tuesday, August 23rd, 2011

Last Friday, a new national crackdown on drunk driving started and will continue through Labor Day Weekend.  The crackdown has a new slogan, “Driver Sober, or Get Pulled Over” but the message remains the same.

No matter what slogan is used, the message is not to drink and drive.  Driving while under the influence of alcohol is a deadly danger that is avoidable. In 2008, 492 people died in Pennsylvania drunk driving accidents.

So, no matter what you call it, no matter what slogan you use to help yourself remember to avoid drinking and driving, our accident and injury attorneys urge you to protect yourself and others by refusing to drink and drive during this national crackdown and at all other times.

What Happens if You are in a Crash with a Pennsylvania Horse and Buggy

Friday, June 24th, 2011

There is so much that is unique about Pennsylvania.  One of those things is the way that buggies and motor vehicles share the road in a manner not seen in other parts of the country.  Most of the time buggies and motor vehicles are able to coexist peacefully because both types of drivers are required to follow similar rules of the road.

For example, it is against the law for both a motor vehicle driver and a buggy driver to drink and drive.  Just last week, two buggy drivers were arrested for DUI after they drove their buggy into the path of a car in Western Pennsylvania.  Only the horse was injured in that crash and the horse is expected to survive.

If you have been in an accident with a horse and buggy then you may have legal rights to a potential recovery depending on the circumstances of the case.  For more information, please contact a PA auto accident lawyer for a free consultation.
